These terms govern your use of dirtlab.co.za and purchases from Dirtlab (PTY) Ltd. Please read them before placing an order and keep a copy. The product page, checkout summary and written order confirmation form part of the terms for that order. If a term conflicts with a right you have under South African law, that legal right prevails.

1. Who you’re buying from

Seller: Dirtlab (PTY) Ltd (“Dirtlab”, “we”, “us”) Company registration number: 2026/739233/07 Place of registration: South Africa Email: info@dirtlab.co.za Website: https://dirtlab.co.za/ We sell motorcycle and quad parts, tyres, riding gear, accessories and related products. The main characteristics of each product are described on its product page. If a material detail isn’t clear, please ask us before ordering.

2. Who may use the site

You must be legally able to enter into a purchase agreement. If you’re under 18, please use the site and place orders with a parent or guardian’s involvement. If you order for a business or another person, you confirm that you’re authorised to do so. You must provide accurate delivery and contact details.

3. Accounts and security

Keep your account password private and tell us promptly if you suspect unauthorised access. You’re responsible for activity you authorise through your account. We may suspend access where reasonably necessary to protect the site, investigate suspected fraud or address a serious breach of these terms. Suspending an account does not cancel an accepted order or remove a refund or other statutory right.

4. Product information, images and availability

We take reasonable care with descriptions, images, prices and stock information. A screen may show a different colour, and an image may include accessories, colour options or multiple items for illustration. The written description and selected variation identify what you’re ordering. If the description and image conflict, ask us before ordering. We won’t use an image disclaimer to excuse a materially inaccurate description. Stock can change while an order is being placed. A listing or cart entry doesn’t guarantee availability. If an item becomes unavailable after you’ve paid, we’ll tell you and offer the lawful options, including a refund. We won’t substitute a different item without your agreement.

5. Fitment and vehicle compatibility

Parts finders, model lists and fitment notes are shopping aids. Motorcycle and quad variants can differ by year, market, trim, prior modifications and manufacturer updates. Before ordering or fitting a part, check the exact vehicle model and year, part number, dimensions, specifications and listing notes. If you need help, send us the vehicle details and ask before ordering. Our fitment information is based on information available to us and is not a substitute for a workshop manual or a qualified mechanic’s inspection. To the extent the law permits, we aren’t responsible for loss caused solely by incorrect vehicle details supplied by a customer, an undisclosed modification or installation contrary to clear instructions. If we supplied the wrong item, gave materially incorrect fitment information, or the goods are defective or unsuitable for a particular purpose you told us about and we accepted, your legal remedies remain available.

6. Safety and installation

Motorcycling and workshop work carry risks. Read all product warnings and follow the vehicle and product manufacturers’ instructions, torque settings, maintenance intervals and road-use requirements. Safety critical items, including brakes, tyres, steering and suspension components, should be fitted and checked by a suitably qualified person. Don’t use an item that appears damaged, incorrectly fitted or unsafe. Important safety notice: Incorrect selection, fitting, maintenance or use of a part can cause mechanical failure, a crash, serious injury or death. Protective gear reduces some risks but cannot eliminate the risk of injury. Make sure the item is suitable for the rider, vehicle and intended use before using it. This notice does not remove our legal responsibilities for defective or unsafe goods.

7. Prices and promotions

Prices are in South African rand. The checkout must show the item price, applicable taxes, delivery charges and total payable before you commit to the order. Prices and promotions may change for future orders. We won’t increase an accepted order’s price without your agreement. If a price or promotion is clearly wrong because of a technical or human error, we may contact you before accepting the order. You can then accept the corrected price or walk away. If you’ve already paid and don’t agree, we’ll refund you.

Free delivery on qualifying orders

We offer free standard delivery when the order’s product total is more than R2,000 after discounts and the delivery address is in an eligible major-city area within South Africa. Delivery charges do not count towards the threshold. Tyres and bulky items are excluded from free delivery even when the order meets the threshold. Remote-area deliveries are also excluded. Express delivery and other upgraded services are not included. Enter your delivery address at checkout to see whether free standard delivery is available and what any excluded items will cost to deliver. The applicable delivery charge is shown before you place the order. We won’t add a charge to an order we’ve already accepted without your agreement. If the checkout charge seems inconsistent with this offer, please contact us before paying so we can check it. Free delivery has no cash value and cannot be applied to an earlier order.

8. Placing an order

Before submitting an order, you can review your cart, delivery address, selected options, charges and payment method, and correct mistakes or leave checkout. Submitting an order is an offer to buy. An automated acknowledgement means we’ve received it, not necessarily that we’ve accepted it. We accept the order when we send an express acceptance or dispatch confirmation. We may decline an order for a genuine stock, payment, pricing, delivery or fraud issue, and will tell you and refund any payment we cannot lawfully retain. We’ll send order details electronically. Please save the confirmation and these terms. You can request a copy of your order record by emailing us. If you spot a mistake after submitting, contact us immediately. We’ll try to help before dispatch, without limiting a cancellation right the law gives you.

9. Payment and fraud checks

Payment methods available for your order are shown at checkout. Payments may be handled by an independent payment provider. We may use reasonable verification steps before dispatch where a transaction appears suspicious. We’ll use information for those checks in line with our Privacy Policy. Please don’t send full card numbers or security codes by email. We must use a payment system that meets the security standard required by law.

10. Delivery and collection

We deliver within South Africa to the address agreed for the order. Please allow up to three working days after payment is confirmed for us to pack and dispatch an available item. Courier delivery time starts after dispatch. Available delivery or collection methods, charges and expected delivery time must be shown before you place the order or agreed with you. Dates described as estimates may change, but we’ll keep you informed of a material delay. If no different time is agreed, the legal time limits for fulfilling an online order apply. Please give a complete, accessible address and ensure someone can receive the parcel. We may ask for reasonable proof of delivery or collection. If delivery fails because the address you supplied is wrong or no one is available after reasonable attempts, we may ask you to pay a reasonable, disclosed cost for a further attempt. That doesn’t shift the risk of a parcel lost or damaged before you accept delivery. Goods sent for delivery remain at our risk until you accept them as required by the Consumer Protection Act. Check the parcel when it arrives and tell us promptly about missing, damaged or incorrect goods so we can investigate. A delay in reporting doesn’t automatically take away a statutory claim. If we cannot supply or deliver as agreed, your rights to cancel and receive a refund under applicable law remain intact.

Courier delivery and optional transport insurance

Our courier partner handles the physical delivery after dispatch. If a parcel is lost, damaged or delivered to the wrong address, contact us promptly with your order number and any photos or tracking details. We’ll investigate with the courier and deal with the order in line with your legal rights. Once goods have been delivered to and accepted by you or a person you authorised at the agreed address, you are responsible for their safekeeping, subject to any rights you have in relation to defective or incorrectly supplied goods.

If transport insurance is offered at checkout, you may choose whether to buy it. The cover, price, exclusions and claims process are governed by the insurance terms shown with that option. Please read them before selecting it. Choosing not to buy optional insurance does not make you responsible for a parcel you never received, or waive any right or remedy that South African law gives you against Dirtlab.

11. Ownership

Ownership of goods passes to you after we’ve received full payment and the goods have been delivered, unless the law requires otherwise. This does not change when delivery risk passes under section 10 or affect a lawful return.

12. Cancellations, returns and refunds

Our Returns Policy explains how to request a return and the remedies that may apply to defective goods, incorrect delivery and eligible online transactions. You may have a seven day cooling off right for qualifying online purchases under the Electronic Communications and Transactions Act. That Act contains specific exceptions. A qualifying cancellation is without penalty, apart from the direct cost of returning the goods where the law allows that cost. Other return rights under the Consumer Protection Act remain separate. For goods that fail the Consumer Protection Act’s quality standards within six months after delivery, the Act generally lets you choose a repair, replacement or refund, with the return at our risk and expense. We won’t impose an administration, payment processing or restocking fee on a statutory remedy. A change of mind outside a legal cancellation right does not automatically entitle you to a refund; any voluntary exchange or return must be agreed with us in writing. Please contact info@dirtlab.co.za before sending goods back so we can give you the correct address and instructions. We may inspect a returned item to understand the issue, but an inspection won’t override a remedy the law gives you.

13. Warranties

Any manufacturer’s or extra written warranty is in addition to the statutory implied warranty of quality, not a replacement for it. Warranty information supplied with a product may include instructions for use, maintenance and claims. Ordinary wear, misuse or alteration contrary to instructions may affect a claim, depending on the facts. We won’t reject a claim solely because packaging was opened or a product was fitted.

14. Website content and acceptable use

Dirtlab’s name, original copy, images, site design and other content are owned by us or used with permission. Product brands and manufacturer material belong to their respective owners. You may use the site and keep copies of your order documents for personal use. Please don’t copy site content for commercial use, collect customer information, interfere with security, impersonate another person, send malicious code or use the site unlawfully. We may take reasonable steps to protect the site and its users.

15. Reviews and material you send us

If you post a product review or other material, it must be honest, lawful and relevant. Don’t include another person’s private information or content you don’t have permission to share. You keep ownership of your material, but grant us permission to display it on the site and make formatting changes needed to do so. We may remove material that breaches these rules, is misleading or is unlawful. We won’t edit a review to change its meaning.

16. Links, site availability and information

The site may link to third party services or contain general maintenance and riding information. Third party sites have their own terms and privacy practices. Our general articles don’t replace the instructions for your particular product or vehicle or advice from a qualified professional. We may maintain, change or temporarily suspend the site, but that won’t remove obligations under an accepted order. Tell us if you spot a site error that affects your purchase.

17. Responsibility for loss and limits

Please read this section carefully: It explains when Dirtlab’s liability may be limited. It does not take away a right or remedy that South African law gives you. We remain responsible where the law says we must be, including for applicable claims involving unsafe or defective goods, inadequate safety warnings, misrepresentation, delivery and payment security. Nothing in these terms excludes or caps liability for death or personal injury where such a limit is unlawful, fraud, wilful misconduct, gross negligence, or any other liability that cannot lawfully be limited. Where the law permits, we’re not responsible for loss caused solely by a customer’s misuse of a product, installation contrary to clear instructions, an undisclosed vehicle modification, or a selection made using incorrect vehicle details supplied by the customer. We’ll consider the facts of each case. These examples do not excuse a defect, a materially incorrect description or advice we gave, or a failure to give a required warning. For buyers who are not protected as consumers under the Consumer Protection Act, and only to the extent a limit is lawful and fair, our total contractual liability for direct economic loss arising from a particular order is limited to the amount paid to Dirtlab for that order. This cap does not limit a refund due, a claim for personal injury or property damage caused by unsafe or defective goods, or any liability listed in the second paragraph of this section. To the same limited extent, we’re not liable for lost profit, lost business or other indirect economic loss that was not reasonably foreseeable when the order was accepted. If an event beyond our reasonable control delays performance, we’ll take reasonable steps to reduce the disruption and tell you if it materially affects your order. Your legal cancellation and refund rights still apply. Nothing here shifts delivery risk to a courier or makes you indemnify us for our own conduct.

18. Privacy and communications

Our Privacy Policy explains how we handle personal information. Our Cookie Policy explains cookies and similar tools. We may send order notices, invoices and support responses electronically to the address you provide. Marketing messages are governed by the choices and legal rights described in the Privacy Policy.

19. Complaints and disputes

If something goes wrong, email info@dirtlab.co.za with your order number and a clear description of the issue. We’ll investigate and respond within a reasonable time. You may use any consumer complaint process or court available under South African law. These terms do not require you to give up that right or submit to private arbitration.

20. Changes, governing law and general terms

We may update these terms for future visits and orders. The version in force when we accept your order applies to that order unless you agree otherwise or the law requires a change. South African law governs the terms, and disputes may be brought before a court with jurisdiction under that law. If one clause cannot be enforced, the rest remain effective where they can still operate fairly. A delay in enforcing a right is not a waiver of it. These terms, the relevant product description, the checkout details and our linked policies form the agreement for an accepted online order. A specific written agreement with you takes priority where it clearly says so, subject always to your legal rights. You can save or print this page for your records.
